This is an application under Section 483 of the BNSS, 2023 praying for granting bail to the accused applicant, who was arrested on 13.01.2026, in connection with Umrangso P.S. Case No. 03/2026 under Section 299 of the BNS, 2023 read with Section 67 of the IT Act, 2008. 3. An FIR was lodged on 12.01.2026 by Sri Sudarson Johari of village Sebraikro before the Officer-in-Charge of Umrangso Police Station, alleging that Sahjab Alam (the accused applicant) had posted a picture on Facebook depicting Hindu Goddess, which claimed to have been hurt the religious sentiments of the Hindu community. It was further alleged that the aforesaid picture went viral and therefore, the FIR was filed to initiate action against the accused applicant. 4. Upon receipt of the FIR, the police registered Umrangso P.S. Case No. 03/2026 under the aforementioned sections. 5. Mr. Barbhuiya, learned counsel for the accused applicant submits that the accused applicant is not the person who posted the said picture on Facebook. He further submits that the accused applicant has been behind the bars for the last 38 days and therefore, at this stage, he should be granted bail. 6. Mr. Baruah, learned Additional Public Prosecutor for the State, on the other hand, opposes the bail prayer of the accused applicant. 7. I have considered the submissions made by the learned counsel appearing for the respective parties and also perused the Case Diary, which has been produced by the learned Additional Public Prosecutor. 8. Upon perusal of the Case Diary, this Court finds prima facie very objectionable material depicting a Hindu Goddess and this Court is of the considered view that bail should not be granted to the accused applicant at this Page No.# 3/3 stage.
