Learned advocate for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of the statement of a co-accused and there are no materials to suggest that there has been any recovery from the petitioner subsequently, after the initial seizure was effected from the principal accused. Mr. Biswas, learned advocate for the State, submits that 150 bottles of cough syrup were seized in connection with the instant case at the behest of the BSF. 2 However, so far as the present petitioner is concerned, the case is restricted to the statement of a co- accused. Having considered the nature of the materials appearing in the Case Diary, I am of the view that custodial detention of the present petitioner is unwarranted in the facts and circumstances of the present case. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner be released on bail upon furnishing Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. In view of the charge-sheet having been submitted in connection with the instant case, the order of anticipatory bail will remain in force for a period of four weeks. Accordingly, CRM(A) 872 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. 3 Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
