And In the matter of: Amed Sk @ Gote and another … petitioners Mr. Prabir Majumder Mr. Snehansu Majumder Ms. Sangeeta Chakraborty Ms. Anindita Kundu Mr. Debangshu Majumder … for the petitioners Mr. Shataroop Purkayastha … for the State Learned advocate appearing for the petitioners submits that the petitioners have been implicated for alleged recovery of 55 bottles of phensedyl. The petitioners are in custody for a period of 7 months. Charge-sheet has been submitted before the jurisdictional court and the prosecution has relied upon 11 witnesses in order to prove its case. Learned advocate appearing for the State opposes the prayer for bail and submits that there is antecedent of the petitioner No.1. I have taken into account the nature of the case by which the petitioner No.1 was earlier implicated as an accused under a different case. 2 Having regard to the earlier circumstances, particularly the period of detention and the prosecution proposes to examine 11 witnesses, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. The petitioners, namely, Amed Sk @ Gote and Rintu @ Vilen Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act, Krishnagar, Nadia. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Nadia without prior permission of the learned special court. Thus, CRM(NDPS) 1502 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
