The petitioner has filed the present writ application praying for a direction upon the respondent nos. 6 and 7 to give permission for holding Srabani Mela Festival 2026 from 31st July, 2026 to 14th August, 2026. 2. The Executing Engineer, National Highway, Division-II had filed report wherein certain allegations have been leveled against the petitioner mainly, it is alleged that the petitioner is unauthorizedly collecting the money for allotment of the stalls in the said mela. 3. On receipt of the said report, this Court by an order dated 29th July, 2026 directed the petitioner to provide the list of the intending persons in whose name the stall will be allotted by the petitioner during the mela to the respondent no. 9 by 5:00 p.m. and on receipt of the said details, if 2 any, submitted by the petitioner, the respondent no. 9 is directed to enquire the genuity of the list provided by the petitioner to the respondent no. 9 and to ascertain whether the allegations made by the Executive Engineer in the report is correct or not and to file report before this Court. 4. In spite of the direction passed by this Court dated 29th July, 2026, the petitioner failed to provide the list of the intending persons in whose name stall is going to be provided by the petitioner. 5. This Court has categorically directed the petitioner to supply the list of the proposed intending persons in whose name the stall will be allotted but the petitioner has not complied with the said order. The said act of the petitioner presumed that the allegations made by the Executive Engineer in the report is correct. 6. Accordingly, this Court is not inclined to give any permission to the petitioner to holding Srabani Mela Festival 2026 from 31st July, 2026 to 14th August, 2026. 7. WPA No. 17733 of 2026 is dismissed. 8. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities. (Krishna Rao, J.)
