Today, the learned advocate for the petitioner would submit that the petitioner intends to approach the Tribunal and as such prays for withdrawal of the writ petition. He also insists that considering the fact that the matter was pending consideration before this Court, appropriate benefit under Section 14 of the Limitation Act, 1963 be made available. 2. Having heard the learned advocates appearing for the respective parties since, the petitioner does not wish to proceed with the writ petition on the ground of alternative remedy, I am of the view, let the writ petition be dismissed as withdrawn. 3. If the petitioner is otherwise entitled to prefer an appeal, the petitioner may do so in accordance with law. In such case, the petitioner shall be entitled to the exclusion of the time for which the writ petition was pending. (Raja Basu Chowdhury, J.)
