The challenge in the present petition is to an order dated 17.02.2026, rejecting an application under Order 1, Rule 10(2) of the CPC, passed in O.S.No.123/2021, by the Senior Civil Judge and JMFC, Chintamani at Chikkaballapur (hereinafter referred to as the ‘Impugned Order’). 2. The learned counsel for the petitioner submits that he has rights in the suit schedule property and thus, he had filed an application under Order 1, Rule 10(2) of the CPC, to come on record as a party. 3. The learned Trial Court examined the application and found that since the petitioner has already filed a separate independent suit and given the limited scope of the suit HC-KAR CNR: KAHC010174872026 NC: 2026:KHC:38300 WP No. 7882 of 2026 3 filed before itself, there is no ground made out for impleading the petitioner as a party to the suit. 4. It is not disputed by the parties that the petitioner has filed an independent suit being O.S.No.147/2018, seeking partition and separate possession, which is pending before the learned Senior Civil Judge at Chintamani. 5. After some arguments, the learned counsel for the petitioner seeks permission to withdraw the present petition, with liberty to file an appropriate application before the learned Trial Court seeking that both suits be heard by the same Court. 6. The petition is dismissed as withdrawn, with a liberty as prayed for. The learned Trial Court shall examine the application when filed and proceed in the matter in accordance with law.
