In this case, the petitioner has prayed for expeditious disposal of the proceeding being G.R. Case No,7219 of 2020 presently pending before learned 1st Judicial Magistrate, Barrackpore. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the FIR in the said proceeding was initiated on 14th November, 2020 and the charge sheet was submitted after completion of investigation on 31st December, 2020. After about 4 years, the charge was framed on 14.11.2024 and the prosecution proposes to examine only five witnesses. However, not a single witness has been examined so far by the prosecution and thereby the petitioners who are the accused persons are being deprived of their fundamental right to speedy trial. The next date has been fixed on
23.07.2027. Therefore, the petitioner prays for appropriate direction upon the Court below for expeditious disposal of the proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is
2 allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having heard learned Counsel for the petitioner and that the proceeding has got stalled since 14.11.2024, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, CRR 3149 of 2025 is hereby disposed of with a direction upon the Court below to prepone the next date of hearing and to fix a date in the month of September, 2026 and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the preponed date of hearing.
