Learned advocate appearing for the petitioners submits that the alleged recovery in the present case is 22.957 kgs. of ganja. Another accused, namely, Mustaqui @ Mustafa has been granted bail in CRM(NDPS)1452 of 2026. Prosecution has relied upon 13 witnesses in order to prove its case. Although charges have been framed but witness action has not commenced in the present case.
Learned advocate for the State opposes the prayer for bail.
Having considered the quantum of recovery in the present case and that some time will be required to take the trial to
2 its logical conclusion, I am of the view that further detention of the present petitioners are unwarranted.
Accordingly, the prayer for bail of the petitioners is allowed. The petitioners, namely, Deepak Poddar and Faruk Seikh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Paschim Medinipur. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Paschim Meinipur without prior permission of the learned special court.
Thus, CRM(NDPS) 1528 of 2026 is allowed.
