The case of the prosecution is that on 05.04.2025 at about 11.15 a.m., the petitioner along with A1 was found in illegal possession of 21.200 kilograms of ganja. Hence, the case has been registered. 3. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that on the date of occurrence the petitioner fled away from the scene and therefore no recovery could be effected from him. It is further submitted that the total quantity involved is 21.200 kilograms of ganja, which is a commercial quantity. The petitioner is also stated to be involved in six previous cases, out of which two have been disposed of. 5. From the submission of the learned counsel on either side, this Court is of the view that the quantity involved is a commercial quantity attracting the rigour under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
