In this writ petition, the petitioner is assailing the Memorandum dated 16.01.2026 (Annexure-E) and the letter dated 18.02.2026 issued by the respondent No.4 (Annexure-F). 3. Sri V.Shivakumar, learned counsel appearing for the petitioner contended that, the land in question has been granted to the petitioner and petitioner is in cultivation of the same for more than five decades and, therefore, submitted that the petitioner cannot be dispossessed from the subject land and accordingly sought for interference of this Court. 4. Per contra, learned AGA submits that the land bearing Sy.No.41 of Kanivenarayanapura Village of Chikkaballapura Taluk, is a tank and the petitioner herein has encroached the land belonging to the Government - 4 - HC-KAR CNR: KAHC010440412026 NC: 2026:KHC:37716 WP No. 20072 of 2026 and, therefore, survey has been conducted by the respondent – Authorities and accordingly sought for dismissal of the petition. 5. In the light of the submissions made by the learned counsel for the parties, careful consideration of the papers would indicate that, the land bearing Sy. No. 41 of Kanivenarayanapura Village of Chikkaballapura Taluk is a Government land, where the Government tank is situated. 6. In that view of the matter, as the respondent - Authorities have taken steps to remove the encroachment in the Government tank, I am of the view that, no interference is called for in this petition and it is open for the respondent - Authorities to conduct survey and remove the encroachment, if any, in the Government land. 7.
