This is an application for appointment of arbitrator filed under section 11 of the Arbitration and Conciliation Act, 1996. The petitioner claims to have entered into an agreement with the respondent for “Construction and improvement of rural road under Pradhan Mantri Gram Sadak Yojana –I scheme, batch-II, CD-I, APWD, Rangat under Rangat Tehsil (package No. AN03RT02, 05 & 06)” under agreement dated 23.07.2020. 2. Disputes and differences have arisen by and between the parties in connection with the execution of the contract. The petitioner invoked clause 24 of the contract agreement and made several claims before the Executive Engineer, CD-I, APWD, Rangat but did not receive any reply of the same. The respondent thereupon addressed a communication dated 20.03.2026 to the Chief Engineer, APWD, Port Blair, asking for appointment of Arbitrator which has not being complied with. 3. In that view of the matter, let the disputes and differences between the parties be referred to the arbitration of retired the Chief Justice of the High Court at Calcutta, namely, Shri Girish Chandra Gupta (9830929723). The venue of the arbitration shall be at Sri Vijaya Puram formerly known as Port Blair. 4. The arbitration shall be conducted in terms of the Act of 1996 and the Rules framed thereunder. The fees of the arbitrator shall be governed by the Act of 1996 and the said Rules. 5. The parties may conduct the proceedings upon mutually agreed convenience by video conferencing from time to time. 6. With the aforesaid observation, AP/7/2026 stands disposed of. 7. The parties shall communicate a copy of this order to the learned Arbitrator. 8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court. ( Rajasekhar Mantha, J. )
