JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.6 in S.C.No.175/2023 pending before the Court of Principal District and Sessions Judge, Davanagere arising out of Crime No.46/2023 registered by Nyamathi Police Station, Davanagere for the offences punishable under Section 143, 147, 148, 324, 326, 302, 307, 120B, 201, 212 read with Section 149 of IPC, 1860, is before this Court in this successive bail petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. - 3 - HC-KAR CNR: KAHC010098162026 NC: 2026:KHC:38702 CRL.P No. 2179 of 2026 3. FIR in Crime No.46/2023 was registered by Nyamathi Police Station, Davanagere against six to seven unknown persons and in the said case, the petitioner herein was arrested on 06.04.2023. After completing investigation, charge sheet has been filed against 19 persons. Bail application filed by the petitioner before the jurisdictional Sessions Court was rejected. Therefore, he had approached this Court along with accused Nos.2 and 3 in criminal petition No.4736/2025 connected with criminal petition No.4734/2025, which was disposed of on 29.07.2025 with liberty to the petitioners therein to file a fresh petition before the Sessions Court, if the charges are not framed within a period of 3 months from the date of receipt of copy of the order passed in the said petitions. Subsequently, the petitioner had filed a fresh bail application before the Trial Court in S.C.No.175/2023, which was rejected on 04.12.2025. Learned counsel for the petitioner submits that in identical circumstances, accused Nos.2 and 3 have been granted regular bail by this Court. He also submits that the petitioner has no other criminal antecedents. 5. Per contra, learned HCGP who has opposed the petition does not dispute the submission made by the learned counsel for the petitioner. 6. This Court in criminal petition No.4994/2026 has granted bail to accused Nos.2 and 3 under similar circumstances. Petitioner is in custody in the present case from 06.04.2023 onwards. Undisputedly, he has no other criminal antecedents. Prosecution has altogether cited 131 charge sheet witnesses in the present case and as on this date, trial has not yet commenced. 7. Under the circumstances, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively on the ground of parity. The petitioner is directed to be enlarged on bail in S.C.No.175/2023 pending before the Court of Principal District and Sessions Judge, Davanagere arising out of Crime No.46/2023 registered by Nyamathi Police Station, Davanagere for the offences punishable under Section 143, 147, 148, 324, 326, 302, 307, 120B, 201, 212 read with Section 149 of IPC, 1860, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 6 - HC-KAR CNR: KAHC010098162026 NC: 2026:KHC:38702 CRL.P No. 2179 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
