2. As per the prosecution story, in brief, on 21.12.2025, during patrolling, the Flying Squad received secret information that the Applicant had kept prohibited drugs in his house. Acting upon the said information, a raid was conducted at the Applicant's house, during which 100 ampoules of Rexogesic Buprenorphine Injection IP 2 ml and 100 ampoules of Avil Pheniramine Injection IP 10 ml were allegedly seized. Subsequently, the Applicant was arrested in connection with the alleged offence. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case and that the alleged seizure memo has been falsely prepared by the police to implicate him. It is further submitted that the mandatory provisions of the NDPS Act have not been complied with during the proceedings. He further submits that the Applicant's wife is in an advanced stage of pregnancy and is likely to deliver shortly. It is also submitted that the Applicant is in custody since 21.12.2025, the charge-sheet has already been filed and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on regular bail.

4. Per contra, learned State Counsel opposes the bail application and submits that the quantity of the alleged contraband seized is above the commercial quantity and that the same was recovered from the Applicant's house, therefore, he is not entitled to be granted regular bail.

Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the fact that the alleged contraband was recovered from the house of the Applicant and the quantity seized is above the commercial quantity, without further commenting anything on the merits of the case, this Court is not inclined to extend the benefit of bail to the Applicant.
6. Accordingly, the bail application of the applicant – Dilip Sonwani involved in Crime No.157/2025 registered at Police Station – Assistant District Excise Officer, Divisional Flying Scot Division, Sarguja (C.G.), for the offence under Section 22(C) of NDPS Act is hereby rejected.
