NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct respondent No.2 to consider its representation dated 01.06.2024 and to direct respondent No.2 to enter its name in all further proceedings relating to acquisition of land in Sy. No.150 (old Sy.No.150/P11) situate at Hulikunte Village, Doddabelavangala Hobli, Doddaballapura Taluk, Bengaluru Rural District. 2. (i) The petitioner claims that it purchased the aforesaid land in terms of a sale deed dated 26.02.2024. In the year 2023, respondent No.2 proposed to acquire the aforesaid land for the purpose of industrial development and issued a preliminary notification dated 26.06.2023 in the name of the - 3 - HC-KAR CNR: KAHC010458932024 NC: 2026:KHC:35996 WP No. 22170 of 2024 erstwhile owner of the aforesaid land from whom the petitioner had purchased the property. Following this, a final notification dated 20.02.2024 was issued, in which also the name of the erstwhile owner was shown. (ii) The petitioner contends that a representation dated 01.06.2024 was given to respondent No.2 to include its name in the acquisition proceedings. It claims that the said representation is not considered and therefore seeks for a direction to respondent Nos.1 and 2 to consider the representation. 3. The learned counsel for the petitioner reiterated the aforesaid contentions and prays to consider the representation of the petitioner. 4. The learned High Court Government Pleader for respondent No.1 submits that if the petitioner purchased the property from the person whose name appeared in the notification prior to the issuance of the notification, respondent No.2 shall take necessary steps, as provided under Section 11 - 4 - HC-KAR CNR: KAHC010458932024 NC: 2026:KHC:35996 WP No. 22170 of 2024 of the Land Acquisition Act, 1894 to consider the claim of the petitioner and take necessary steps for passing an award. 5. In that view of the matter, this writ petition is disposed off directing the respondent No.2 to consider the representation of the petitioner dated 01.06.2024 and if petitioner has purchased the aforesaid land, he shall pass appropriate orders regarding the compensation payable. 6.
