It is the grievance of the petitioner that he is khatiyani raiyat of Jamabandi No.25, P.S. Pakuria, District Pakur, Mauza Jharia, measuring an area of 31 bigha, 19 katha and 10 dhur of land but he has been forcefully dispossessed by the respondent No.6. 3. It is the case of the petitioner that since the respondent No.6 has forcefully evicted the petitioner, the petitioner has approached the Deputy Commissioner, Pakur by filing an application under Section 42 of the Santhal Pargana Tenancy (Supplementary Provisions) Act, 1949. It is his grievance that his application is yet pending. 4. Counsel for the petitioner submits that a direction may be given to the Deputy Commissioner, Pakur to consider the application of the petitioner and take appropriate steps as per law. 5. Counsel appearing on behalf of the respondents submits that though an application is pending, the respondent will take appropriate steps. 6. In view of the order, which I intend to pass, it is not necessary to issue notice or call for counter affidavit. 7. Considering the fact of this case, without entering into the merits of the case, I direct the respondent No.-2-Deputy Commissioner, Pakur to pass an appropriate order on the representation of the petitioner after giving an opportunity of hearing to all the parties concerned. 8.
