2. Considering the nature of prayer sought in the appeal and accepting the cause shown in the memorandum of facts accompanying the application filed under Section 5 of the Limitation Act r/w Section 21(5) of the NIA Act, the delay in preferring the appeal is condoned. I.A.No.1/2026 is allowed.
3. Accused No.6 in SC No.871/2013 on the file of the Court of XLIX Additional City Civil and Sessions Judge (Special Court for the trial of NIA cases) (CCH-50) Bengaluru, feeling aggrieved by the
Order dated 07.01.2026, thereby rejecting his interim bail application filed under Section 439(1) r/w Section 439 of Cr.P.C., has preferred this appeal under Section 21(4) of National Investigation Agency Act, 2008 (for short 'NIA Act'). 4. The appellant along with the other accused is facing trial for the offences punishable under Sections 120B, 121, 121A, 123, 307, 201, 212 of IPC and Sections 3, 10, 11, 13, 16, 17, 18, 19 and 20 of the Unlawful

Activities (Prevention) Act, 1967 (for short 'UA(P) Act' and Sections 3, 4, 5 and 6 of the Explosive Substances Act, 1908 and Section 4 of Prevention of Damage to Public Property Act, 1984. 5. Before the trial Court, an application was filed seeking interim bail for a period of 3 months on the ground that appellant's mother is very critical and she is suffering from urethral stricture and requires repeated urethral dilatation, asthma with bronchiectasis and regular follow-up care for urethral stricture. It is stated that appellant's mother is suffering from recurrent urinary retention and catheterization and she is taking regular treatment, since 2008, at different hospitals but due to incarceration of the appellant, she is not in a position to take proper treatment as there are no other family members to attend, assist or accompany her and he is the only son to her. - 5 -

The Special Court has rejected the prayer for interim bail on the ground that as per the medical certificate, appellant's mother is stable and under Section 43D(5) of the UA(P) Act, there is a bar to grant bail or interim bail to the accused on any ground. 7. The appellant had sought interim bail for a period of 3 months, which period has already expired. However, it is submitted by the learned counsel that the appellant's mother is still suffering from various health issues and she is critical and there is no one to look after her. It is also contended that the appellant is in judicial custody for the past 14 years and even after conclusion of the trial, no judgment is passed, for more than 1 year. 8.
In light of the above submission, we are of the view that the appeal can be disposed of, reserving liberty to the appellant to file a fresh bail application before the trial Court, raising all contentions, including the ground of ill-health of his mother, along with latest medical reports

and on the ground of delay in trial. If any such application is filed, trial Court shall make an endeavor to dispose of the same within 15 days, from the first date of hearing. Hence, we pass the following:
