It is the grievance of the petitioner that he has not been appointed as Intermediate Trained Teacher (Sahayak Acharya) for Para Teacher Category in spite of the fact that he has obtained more marks than the last selected candidate. 3. During course of argument, it has been admitted by the respondent that the petitioner has obtained 227.707 marks whereas in the category of the petitioner, which is Para Category-EBC the last selected candidate has obtained 157.5657. Thus, it is clear that the petitioner has obtained more marks than the last selected candidate. 4. At this stage, Mr. Sanjoy Piprawall, learned counsel for the respondent- JSSC submits that there is some confusion about his graduation from Hindi Vidyapith, Deoghar. The said degree was declared to be null and void. 5. The issue of the degree of Hindi Vidyapith, Deoghar has been set at rest by a Division Bench of this Court in W.P.(C) No.3115 of 2015, wherein it has been held that the degrees issued by the Hindi Vidyapith, Deoghar prior to 26.02.2015 is valid. 6. It is the case of the petitioner that the degree of the petitioner from the said Hindi Vidyapith, Deoghar is of the year 2008-09. If that be so, the petitioner cannot be disqualified. 7. Considering the same, I direct the respondents to take a decision, so far as this petitioner is concerned and if it is found that the degree of the petitioner is prior to the cut off date as fixed by a Division of this Court in W.P.(C) No.3115 of 2015, the name of the petitioner will be recommended for the said post, if there is no other legal impediment. 8.
