Learned counsel for the petitioners submits that he may be permitted to withdraw this writ petition with liberty to file an application before the appropriate authority under Section 3-G (5) of the National Highways Act,1956 (for short “Act of 1956”) and direction be issued to concerned authority to consider and decide the application to be submitted by petitioner within specified time.

Learned counsel for respondent -NHAI would submit that he is having no objection to the limited prayer made by learned counsel for the petitioners.

On due consideration of submission of learned counsel for the respective parties, this writ petition is disposed of permitting the petitioners to submit an application under the provision of 3-G (5) of the Act of 1956 and if such application is submitted, concerned authority shall consider and take decision on the same in accordance with law, expeditiously thereafter.
