The petitioners pray for pre-arrest bail in connection with Dinhata Police Station Case No.374 of 2026 dated 25.05.2026 under Sections 126(2)/118(2)/109(2)/351(2)(3) of Bharatiya Nyaya Sanhita, 2023 read with Section 9(b) of Explosive Act. 2. The learned advocate for the State opposes the prayer for anticipatory bail and produces the case diary. 3. Considering the materials on record and the aspect of political rivalry between two political parties, which are available from the records, this Court is inclined to grant pre-arrest bail. Custodial interrogation of the petitioners will not be necessary. 4. Accordingly, this Court directs that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the 2 Bharatiya Nagarik Suraksha Sanhita, 2023. The further condition is that the petitioners shall meet the investigating officer once a week and shall not leave the jurisdiction of Dinhata Police Station. 5. In case the petitioners fail to adhere to any of the conditions as stated above, the anticipatory bail will stand automatically cancelled. 6. Accordingly, the application for anticipatory bail is allowed and disposed of. 7. Parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
