1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of in FIR No.0110, dated 20.05.2026, under Sections 191(3), 190, 126, 117(2), 115 & 110 of BNS, 2023, registered at Police Station Barara, District Ambala. Further prayer has been made for staying the arrest of the petitioner during the pendency of the present petition.
2. On 02.06.2026, the following order was passed:

Learned counsel for the petitioner has submitted that the petitioner is 18 year old boy, who has been falsely implicated in the present case. He has submitted that there is no opinion given so far by the Doctors regarding the injuries alleged against the petitioner. He has further submitted that the petitioner has no criminal antecedents as he has never been involved in any other case and no prima facie case as alleged against the petitioner is made out, thus, he deserves to be granted anticipatory bail. (iii) Notice of motion. (iv) On asking of the Court, Mr. Tanuj Sharma, AAG, Haryana appears and accepts notice on behalf of the respondent-State. CRM-M-32439-2026 2 (v) To come up on 16.07.2026. (vi) State to file the status report on or before the next date of hearing with an advance copy to the counsel opposite. (vii) In the meantime, no coercive action shall be taken against the petitioner till the next date of hearing. 3. Since there is no allegation of inflicting the injuries covered the offences under Section 113(2) or 109 of BNS, 2023 and petitioner has been made accused without any specific role, he is directed to join the investigation within two weeks from today, or as and when called by the investigating agency, and in the eventuality of the arrest, petitioner would be released on anticipatory bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.). 4. Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport. It is also directed that before leaving country any time during trial, petitioners would seek prior permission of the Court. 5. However, it is clarified that if the petitioner fails to join and cooperate with the investigation, in terms of directions mentioned in the present order, it shall be open for the Investigating Officer to proceed immediately to arrest the petitioner, in accordance with law. 6. With the directions issued here above, present petition stands disposed of.
