1. The petitioner has filed the instant writ petition challenging the action of the respondents as they are not considering her candidature in the matter of advertisement No.19/2024 dated 12.12.2024 for the post of ‘Class-IV Employee’ in the 'General Widow E.W.S.' category for which the cut-off is 0.017, whereas, she has secured 1.6178 marks as per the result declared by the respondents.

Learned counsel for the petitioner submits that the petitioner was issued the E.W.S. certificate on 11.02.2026 and she is eligible

Learned counsel appearing on behalf of respondent- Rajasthan Staff Selection Board strongly opposed the submissions made by learned counsel for the petitioner.

This Court notes that the petitioner appeared in the recruitment process for the advertised post under the ‘General Widow’ category for which the cut-off was declared as 30.6569, whereas she secured 1.6178 marks. Further, when she failed to pass the selection process under the 'General Widow’ category, she obtained a E.W.S. certificate on 11.02.2026, i.e., after the declaration of the result dated 06.02.2026. On account of failure to get her name in the final merit-list, she obtained the said certificate post the result and prayed that her candidature be considered under the ‘General E.W.S. Widow’ category as she had secured marks higher than the cut-off for the ‘General E.W.S. Widow’ category.

In view of the above, it is clear that the petitioner was not having certificate of ‘General E.W.S.’ category at the time of submission of the application as well as at the time of declaration of result dated 06.02.2026, therefore, now she cannot pray for a change of category, more so when she failed to get selected in the respective category in which she applied initially.
6. The Co-ordinate Bench of this Court have considered a similar issue in the matter of ‘Kavita Sharma Vs. Rajasthan Staff Selection Board’ in S.B. Civil Writ Petition No.2491/2026 dated 19.03.2026 wherein the following order was passed:-

“1. Although, the matter was listed on application for stay vacation. With the consent of parties, arguments on writ petition were heard finally.
2. The above writ petition has been filed by the petitioner challenging the denial of correction in her category in the recruitment process for the post of Class-IV employees.

Learned counsel for the petitioner submits that the petitioner participated in the direct recruitment process for the post of Class-IV employee initiated by Rajasthan Staff Selection Board, Jaipur. 4. In the present writ petition, petitioner belongs to 'General EWS Widow' category. On account of the fact that the petitioner is less educated and has no knowledge with regard to computer or the process of filing the online application form, got her form filled through third person/E-Mitra, who instead of showing the category of petitioner as 'General EWS Widow', showed the petitioner as 'General Widow'. 5. It is also submitted by learned counsel for the petitioner that after filing the application form, the petitioner participated in the written examination and although, she secured more marks than the cut-off marks declared for 'General EWS Widow' candidate, yet only on account of human error occurred while submitting the application form, the petitioner was not considered in the category of 'General EWS Widow'. 6. It is further submitted by learned counsel for the petitioner that after declaration of result, petitioner also submitted application/affidavit seeking correction in her category, yet no action was taken by the respondent-Board. It is also submitted that, in case, the petitioner was

I have heard learned counsel for the petitioner and perused the record. 8. Clause 17 of the advertisement issued by respondent-Board is reproduced hereunder:

Aforesaid Clause of the advertisement would make it clear that in order to obviate any possibility of discrepancies in the application as well as to grant opportunities to the candidates for making necessary correction in the application form, provisions have been made, where on two different occasions rectification in the application form was allowed.
Firstly, the candidate could have made rectification within seven days from the last date of filing of application form and as per Clause 17(ii) of the advertisement, and even if any candidate fails to make rectification and could not avail the first opportunity then, after completion of examination, second opportunity would be granted to the respective candidate for making necessary corrections. 10. In the instant case, before appearing in the examination, the petitioner was issued admit card, in which also category of the petitioner was shown as 'General Widow' and not as 'General EWS Widow', even then, the petitioner did not raise any objection and appeared in the examination as

Even after examination, Board has issued one press note as well as published it on its official website granting opportunity of rectification in the application form even after completion of examination. However, the petitioner even then did not submit any application for seeking the necessary rectification. 11. It is only after declaration of result, when the petitioner found that she has not secured proper place in the selection list as per the category filed by her, she submitted application for rectification, which was not entertainable as per the Scheme of examination declared by respondent-Board. 12. It is settled proposition of law that category of the candidate cannot be allowed to be changed at subsequent stage, as held by the Co-ordinate Bench of this Court at Principal Seat, Jodhpur in D.B. Civil Writ Petition No.15900/2021 (Mustak Khan Vs. The Rajasthan High Court Jodhpur & Ors.), the relevant portion of the aforesaid order is reproduced as hereunder:-
"5. On the other hand, learned counsel for the respondents while relying on the
judgment of this Court in Sunil Bhanwariya v. Registrar, Examination Cell, RHC, Jodhpur & Anr. submits that the petitioner having participated in the preliminary examination in the General category cannot raise this issue at belated stage after declaration of the result for the post of District Judge.
8. In the considered opinion of this Court, having participated in the examination and knowing that he has applied in the General category, he cannot be allowed to change his category from General to OBC (NCL) category. No prima facie case is made out by the petitioner. He did not file any proof to the effect that he made any endeavour to

13. In the light of above discussion as well as the observations made by the Division Bench of this Court, this Court does not find any ground to interfere in the instant writ petition and, the same, is hereby, dismissed.
14. Pending application(s), if any, shall stand
disposed of.”
7. In view of the above, this Court finds no merits in the present writ petition. Consequently, this writ petition is dismissed.
