Heard the learned counsel appearing for the petitioner and the learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents 1 to 4. Perused the materials available on record. 3. According to the petitioner, subsequent to the purchase of the property, the respondents 6 and 7 trespassed into the property. 4. It is seen from the records that a civil dispute is pending in respect of the property between the petitioner’s vendor and the respondents 5 and 6 herein. It is settled law that the police protection cannot be granted to evict the parties from an immovable property where civil rights are yet to be adjudicated. Therefore, the petitioner ought to have approached the competent Civil Court for appropriate reliefs against the respondents 5 to 7 herein. 5. In view of the above, the prayer sought for in this petition cannot be granted. Thus, the writ petition lacks merit and is liable to be dismissed. Accordingly, this Writ Petition (Criminal) stands dismissed. However, the petitioner is at liberty to approach the Civil Court for appropriate relief.
