JUSTICE ANU SIVARAMAN) Heard the learned counsel appearing for the complainant as well as the learned counsel appearing for respondent No.1/accused No.1 and the learned Additional Government Advocate appearing for respondent No.2- State. 2. It is submitted by the learned counsel appearing for accused No.1 that, pursuant to the direction issued by the learned Single Judge for consideration of the claim of the complainant for allotment of a site, the representation of the complainant dated 16.02.2024 has been considered and an endorsement dated 28.10.2024 has been issued to the complainant. 3. It is submitted by the learned counsel for the complainant that the reason for rejection is identical to what was earlier stated in the objection raised before the learned Single Judge. 4. Having considered the contentions advanced, we notice that W.A.No.165/2023 filed against the Order dated - 4 - HC-KAR CNR: KAHC010750852024 NC: 2026:KHC:38169-DB CCC No. 1408 of 2024 10.06.2022 of the learned Single Judge in W.P.No.7564/2022 was dismissed on 02.03.2023 making it clear that, the dismissal of the writ appeal will not be a precedent. 5. In the above view of the matter, we are of the opinion that the correctness or otherwise of the endorsement cannot be considered in these proceedings. The Contempt of Court Case is accordingly closed, leaving open the contentions of the parties and the right of the complainant to challenge the endorsement, if so advised.
