Learned counsel for the applicant submits that vide order dated 03.09.2025 passed in W.P.(C) No. 4755 of 2025, this Court disposed of the writ petition directing the petitioner to vacate the premises/land in question within a period of sixty (60) days from the date of the said order. It is contended that the petitioner is an elderly widow lady who has been unable to secure alternative accommodation within the stipulated time. On the aforesaid humanitarian ground, learned counsel confines his submissions seeking a further extension of time for compliance with the said order. It is further submitted that the application seeking restoration of W.P.(C) No. 4755 of 2025 may be allowed and the effect and operation of the order dated 03.09.2025 be extended for a further period of sixty (60) days. Learned State Counsel, fairly submits that he has no objection to the prayer made by learned counsel for the applicant. Having considered the submissions advanced by learned counsel for the parties and taking note of the peculiar facts and circumstances of the case, particularly the status of the petitioner as an elderly widow, the present Miscellaneous Case (MCC) is allowed. Accordingly, the applicant is granted a further period of two 3 months from today to avail appropriate legal remedies and to initiate proceedings before the competent forum, in accordance with law and following due process. Consequently, W.P.(C) No. 4755 of 2025 is restored to its original number, and the effect and operation of the order dated 03.09.2025 shall remain extended for the aforesaid period.
