ORAL ORDER
1. Learned AGA is directed to accept notice for the respondents.
2. The petitioner is before this Court seeking for the following reliefs:
“WHEREFORE, the Petitioner respectfully prays that this Hon'ble Court may be pleased to:
(a) Issue a writ, order or direction in the nature of mandamus directing Respondent No.2 to forthwith consider and dispose of the Petitioner's representation dated 24.06.2019 (ANNEXURE -B) by passing a reasoned and speaking order, in strict compliance with the
order in W.P.No.1906/2018 dated 28.03.2019 passed by this Hon'ble Court (ANNEXURE-A), within such time as may be deemed fit by this Hon'ble Court;
(b) Direct the Respondents to ensure that no coercive steps are taken against the Petitioner in relation to the affairs of M/s. Attica Gold Pvt. Ltd. on the basis of his erstwhile position as Director subsequent to his resignation with effect from 01.01.2016, till the representation is considered and decided;
(c) Pass such other order or direction as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.”

3. The grievance of the petitioner is that the representation submitted by the petitioner on 24.06.2019 has not been considered by the respondents. By the said representation, what has been sought for by the petitioner is for the petitioner not to be named as an accused in connection with any alleged offences relating to M/s. Attika Gold Private Limited, subsequent to the date of his resignation on 01.01.2016 and he may be dropped as an accused in all cases where he has been named as an accused in all the capacity of Managing Director of M/s. Attika Gold Private Limited in connection with the offences alleged to have committed subsequent to 01.01.2026.
4. A representation not to name a person as an accused or to delete the name of a person as an accused cannot be considered and orders passed by the respondent Authorities. If at all, the petitioner claims that he was not the Managing Director as on

the date on which the offence was committed, it is for the petitioner to raise such a defence in the proceedings, which have been filed and it should have to be considered by the concerned Court.
5. A representation of the above nature not being maintainable, the writ petition stands dismissed.
