And In the matter of: Paritosh Barman ….Petitioner. Mr. Partha Pratim Sarkar, Mr. Bappaditya Roy …for the Petitioner. Mr. Janardan Periwal, Mr. Reshab Kumar, Mr. Nigam Mittal … for the State. 1. The petitioner is the husband of the victim. He prays for pre-arrest bail in connection with Sitalkuchi Police Station Case No.212 of 2026 dated 25.05.2026 under Sections 85/109 of Bharatiya Nyaya Sanhita, 2023, on the ground that he has two minor children and FIR does not disclose any cognizable offence. 2. The learned advocate for the State opposes the prayer for anticipatory bail and submits that the petitioner is in the habit of beating up his wife. 3. Perused the injury report and the materials on record. Considering the nature of injury and the nature of allegation, the prayer for anticipatory bail is allowed. 4. Accordingly, this Court directs that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.50,000/- with two sureties of like amount each, both should be local, to the satisfaction of the arresting officer and subject to the 2 conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The further condition is that the petitioner shall meet the investigating officer once a week and shall not enter the jurisdiction of Sitalkuchi Police Station except for the purpose of meeting the investigating officer. The petitioner will inform the investigating officer of his present residential address. 5. In case the petitioner fails to adhere to any of the conditions as stated above, the anticipatory bail will stand automatically cancelled. 6. Accordingly, the application for anticipatory bail is allowed and disposed of. 7. Parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
