THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in S.C.No.128/2017, pending before the II Additional District and Sessions Judge, Chikkamagaluru, for the offences punishable under Sections 504 and 307 of the IPC. 2. Learned counsel for the petitioner and respondent No.2 in unison would submit that the parties to the lis have settled their disputes amicably by drawing up certain terms and conditions before the concerned family Court in M.C.No.146/2023. The parties have parted their ways. They - 3 - HC-KAR NC: 2026:KHC:35078 CRL.P No. 9949 of 2026 are before this Court seeking permission to compound the offences. They have appended a certified copy of the judgment of the concerned family Court and filed a memorandum of settlement / compromise petition under Section 359 r/w. 528 of the BNSS / 320 of the Cr.P.C. along with a joint affidavit before this Court to that effect. 3. The joint affidavit reads as follows: “JOINT AFFIDAVIT I Pallavi, W/o Kiran Kumar, Aged about 27 years, R/at Door No.78, 15th cross, ‘a’ Bandappa Garden, Muthyal Nagar, Yashwanthpura, Near J.P.park back side, Bengaluru and Kiran Kumar, S/o Thimme Gowda, Aged about 39 years, R/at Thadabenahalli Village, Lakya Hobli, Chikkamagalur district, today at Bangalore do hereby solemnly affirm and state an oath as follows; “1. We submit that, we are the petitioner/Accused No.1 and complainant/Respondent No.2 in the above case as such we are conversant with the facts and circumstances of the case. Hence competent to make this affidavit. 2. We submit that, case has been registered against petitioner on the basis of the complaint filed by the Respondent No.2 for the offence under section 504, 307 OF IPC pending on the file pending on the file of Prl. District and Session Judge at Chikkamagaluru in SC. No. 128/2017. 3. We submit that, as per the undertaking given by both the parties in MC. No. 146/2023 both the parties are not willing to continue the criminal prosecution against each other therefore in view of the undertaken given by the parties seeking permission of this court to compound the offence in the pending proceedings against each other and - 4 - HC-KAR NC: 2026:KHC:35078 CRL.P No. 9949 of 2026 also the Respondent No. 2 is not willing to continue the prosecution against the petitioners. Hence both we are seeking for compounding of the offence against the petitioner for the same the Respondent No. 2 have no objection to compound the offence. In view of the said fact this Hon'ble court permit us to compound the offence by way of compromise in view of the same quash the proceedings against the petitioners for that both we are agree and had no objection. 4. We submit that, whatever stated above are true to the best of our knowledge, belief and information.” In the light of the afore-quoted joint affidavit, as the dispute is between the couple and the allegations are not against the State, I deem it appropriate to accept the application and the joint affidavit and terminate the proceedings against the petitioner. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in S.C.No.128/2017, pending before the II Additional District and Sessions Judge, Chikkamagaluru, stand quashed. I.A.No.1/2026 also stands disposed, as a consequence.
