“1) The Hon'ble court may be kind enough to issue a Writ of Mandamus or any other appropriate writ, order, or direction commanding the Respondent authorities to forthwith calculate and release the full statutory amount of Gratuity due to the Petitioner post-retirement, in the ends of justice. 2) The Hon'ble court may be kind enough to issue a Writ of Mandamus directing the Respondents to pay statutory/commercial interest (at the rate of 8% to 10% per annum) on the delayed payment of Gratuity w.e.f. the date of superannuation (30.06.2012) till the date of actual payment. 3) Pass any other relief(s) or order(s) as this Hon'ble Court may deem fit and proper in the interest of justice.”
2. Learned counsel for the petitioner submits that the petitioner retired from the post of Accounts Assistant in the District Treasury Office, Korba, on 30/06/2012. However, the gratuity payable to the petitioner has not been released till date on the ground that a criminal case was pending against him, in which he was convicted in the year 2017. Learned counsel submits that as far as the pension is concerned, the petitioner is receiving the same. No departmental enquiry has been conducted against the petitioner before his retirement. Learned counsel further submits that the petitioner has submitted a representation before respondents authorities, which is still pending consideration,
3 therefore, prays that the respondents may be directed to consider and decide the said representation. 3.
Learned State counsel submits that, if the representation (Annexure P-1) is still pending before the concerned authority, the same shall be considered and decided within a period of five weeks. 4. I have heard learned counsel for the parties, perused the pleadings and documents. 5. Considering the submissions advanced by learned counsel for the parties and without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to the respondents authorities to consider and decide the representations of the petitioner, in accordance with law within a period of five weeks from the date of receipt of copy of this order.
