2 the Applicant who is apprehending his arrest in connection with Crime No.294/2026 registered at Police Station – Telibandha, District Raipur (C.G.) for the offence punishable under Sections 120-B, 420, 467, 468 and 471 IPC. 2. According to the case of the prosecution, the accused persons, in furtherance of a criminal conspiracy, prepared forged and fabricated documents, including an agreement to sell and a sale deed purportedly executed on 08.02.2012, in respect of the complainants' agricultural land bearing Khasra No. 289/98 (earlier referred to as 189/98), admeasuring 0.202 hectares, situated at Village Amlidih, P.H. No. 69, Tehsil and District Raipur, with the intention of usurping the said property. During investigation, it was allegedly found that the signatures, stamps and other documents used in the agreement to sell were not genuine, the stamp purportedly used was not reflected in the official stamp sale register and the documents had been forged to create a false claim over the property. It is further alleged that the accused persons attempted to take possession of the land by placing machinery and vehicles thereon. The investigation further revealed that examination of other relevant documents, the role of the co-accused and other aspects of the conspiracy is still in progress, reports have been sought from the Tehsildar
3 and the Office of the Sub-Registrar regarding the disputed land and certain co-accused persons are yet to be traced. Accordingly, the offences as mentioned above came to be registered against the present Applicant. Hence, this application. 3. Learned Senior Advocate appearing for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case.
It is submitted that no incriminating material has been recovered from the possession of the Applicant, an agreement to sell dated 08.02.2012 was duly executed between the parties in respect of the disputed land for a total consideration of Rs.25,21,000/-, out of which Rs.5,21,000/- was paid as earnest money and since the complainant failed to execute the sale deed despite the agreement, the Applicant instituted Civil Suit No.24A/2025 for specific performance and permanent injunction on
07.03.2025. It is contended that the present FIR came to be lodged only thereafter on 10.07.2026 alleging that the agreement was forged, which itself demonstrates that the complaint is a counterblast to the pending civil proceedings. It is further submitted that pursuant to the said agreement, possession of the disputed land had already been handed over to the Applicant, who, being a contractor, had stationed
4 his JCB, Hydra machines and other construction equipment on the land. It is also submitted that when the complainant's husband and others allegedly trespassed into the property on 18.07.2026 by breaking open the lock, an FIR bearing Crime No.305/2026 was registered at Police Station Telibandha at the instance of the security guard, Yogesh Yesne. It is lastly submitted and conclusion of the trial is likely to take considerable time, therefore, the Applicant may be granted anticipatory bail. 4. On the other hand, learned State Counsel and the Objector opposed the application. Learned Counsel for the State submits that there are two previous criminal antecedents against the present Applicant. 5.
Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the fact that the dispute between the parties arises out of an agreement to sell in respect of the disputed property and that Civil Suit No.24A/2025 for specific performance is already pending between them, the fact that the present FIR came to be lodged subsequent to the institution of the said civil suit, the fact that the trial is likely to take considerable time for its conclusion and without further commenting anything on the merits of the case, this Court is
5 of the considered opinion that it is a fit case to allow the application. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Jayendra Singh Bhandari, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such fact to the Court. (b) The Applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant/s shall appear before the trial Court on each and every date given to him/her/them by the said Court till disposal of the trial. (d)The Applicant/s and the surety shall submit a copy of his/her/their adhaar card along with a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant/s

not
