205 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-28112-2026 Date of Decision:17.07.2026 Praveen Kumar …Petitioner Vs. State of Punjab …Respondent Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Sumeet Singh Brar, Advocate for the petitioner. Mr. Sartaj Singh Gill,Sr. DAG, Punjab. Mr. Ketan Chopra, Advocate (POA filed) for the complainant. *** N.S.Shekhawat J. (Oral) 1. The petitioner has filed the present petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.07, dated 17.09.2025 registered under Sections 419,420,465, 467,468,471,120-B of IPC and Section 82 of Registration Act, at Police Station Punjab State Crime, District SAS Nagar, Mohali (Annexure P-1). 2. Learned counsel for the petitioner contends that earlier also, the complainant had moved several complaints against the present petitioner, but no substance was found in the allegations levelled by him. He refers to the enquiry report dated 14.06.2021 prepared by Additional Commissioner of Police, Ludhiana (Annexure P-2) to contend that the allegations levelled by the complainant were found to be false. He further submits that even the petitioner had no concern with the alleged Power of Attorney dated 23.03.2015, sale deed dated 23.03.2015 and mortgage deed bearing No.105869 dated 31.10.2019. HITESH 2026.07.17 15:31 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-28112-2026 -2 Even the petitioner had moved various applications to the revenue authorities in this regard also. Apart from that, it is also apparent that a civil litigation with regard to the present controversy is pending before the Civil Court. The entire case is based on documentary evidence, which has already been collected by the police, during the course of investigation. The petitioner was arrested in the present case on 19.01.2026 and is in custody since then. He further submits that all the offences in the present case are triable by the Court of Magistrate and the conclusion of the trial may take quite a long time. He further submits that petitioner is facing trial in five other cases, but he is on bail in all these cases. 3. On the other hand, learned State counsel assisted by learned counsel for the complainant have vehemently opposed the submissions made by learned counsel for the petitioner on the ground that the petitioner is involved in several other cases of similar nature and keeping in view the gravity of the offence, the petition deserves to be dismissed by this Court. 4. I have heard the learned counsel for the parties and perused the record carefully. 5. In the present case, the petitioner is stated to be in custody for the last more than six months and even trial has not even formally commenced against him. Further, the petitioner is involved in other criminal cases, but the same can never be ground for rejection of present bail application, especially when he has been able to make out a case for grant for bail in the peculiar facts and circumstances of the present case. Moreover, the apprehension expressed by learned State counsel can be addressed by imposing stringent conditions on the petitioner while granting him concession of bail in the present case. HITESH 2026.07.17 15:31 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-28112-2026 -3 6.
