This revisional application has been filed seeking expeditious disposal of the trial in Complaint Case No. C- 469 of 2023, instituted under Section 452 of the Companies Act, which is presently pending before the Court of the Learned Judicial Magistrate, 3rd Court, Barrackpore, North 24 Parganas. Mr. Satadru Lahiri, learned Advocate appearing for the petitioner, submits that the concerned employee has been in illegal occupation of the property in question since October 2017. It appears that the Learned Magistrate in the Court below has fixed 2 December 2026 for recording of evidence. Having regard to the nature of the proceeding and the period for which the matter has remained pending, this Court is of the view that the Learned Magistrate should
2 take necessary steps for expeditious disposal of the proceeding. Accordingly, this revisional application stands disposed of with a direction upon the Learned Magistrate in the Court below to conclude the proceeding as expeditiously as possible, preferably within a period of one year from the date of communication of this order, without granting any unnecessary adjournment to either of the parties. The petitioner shall be at liberty to file an appropriate application before the Learned Magistrate for preponing the date fixed for recording of evidence. Accordingly, CRR 2973 of 2026 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
