1. Petitioner is Public Prosecutor-in-Charge, Diamond Harbour Criminal Court who has approached this Court with the present writ petition, inter alia, praying for directions which will permit the petitioner to function as Public Prosecutor-in-Charge and perform his professional duties. It is alleged in the complaint dated 9th July, 2026 of the petitioner addressed to the Superintendent of Police, Diamond Harbour Police District that petitioner is facing difficulty in performing his professional duty and conducting cases on being prevented by some members of Bar. 2. Inspector-in-Charge, Diamond Harbour Police Station has filed a communication dated 27th July, 2026 and same is taken on record. Copy
2 of the communication is made over to the learned advocate representing petitioner. 3. It is disclosed in the communication that on enquiry it was found certain incidents took place which posed threat to dispensation of justice as petitioner was prevented from discharging his duty as Public Prosecutor-in- Charge. 4. Having considered the case made out in this writ petition and contents of communication dated 27th July, 2026 it appears to this Court in spite of necessary direction was issued by learned Legal Remembrancer, Government of West Bengal thereby permitting the petitioner to function as Public Prosecutor-in-Charge in Diamond Harbour Criminal Court he is being prevented by some members of Bar from discharging duty thereby impacting Court proceedings. 5. Since alleged incident took place within the precincts of Court premises, at this stage Court is not inclined to direct police authorities to take steps within the Court premises for bringing normalcy thereby facilitating petitioner to function as Public Prosecutor. 6. Learned District Judge, South 24 Parganas is requested to take steps for resolving the issue
3 and in the process if he finds assistance of police is required same shall be sought for. If request is made from the office of the Learned District Judge to the concerned police authorities necessary assistance shall be provided in order to ensure that petitioner can perform his professional duty being Public Prosecutor-in-Charge without any hindrance. 7.
Court expects on intervention of learned District Judge issue will be resolved shortly. 8. Writ petition stands disposed of. 9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
