For the Petitioner Mr. Rahul Agarwala …. For the State Affidavit of service filed on behalf of the petitioner is taken on record. The petitioner alleges that the Panchayat Authority is trying to take forcible possession of the water body owned by the petitioner. The petitioner has learnt that the Government is planning to implement a project over the said water body and for the purpose, de-silting process is in progress. On prayer of the petitioner liberty is granted to submit a comprehensive representation ventilating his grievance before the Pradhan, Debanandapur Gram Panchayat, being the 7th respondent herein, within a fortnight from date. The 7th respondent is directed to consider and dispose of the same within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. 2 The decision taken by the authority shall be communicated to the parties within a week thereof. Pending disposal of the representation, the water body shall not be dealt with in any manner by the Panchayat authority. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
