ORAL ORDER
1. In this Writ Petition, petitioners are assailing the endorsement bearing No.LND(V)CR.121/2021-22 dated 06.05.2022(Annexure-F) issued by respondent No.2, inter alia, sought for a direction to the respondents to provide connecting road to the land bearing Sy.No.145 at Amani Bellanduru Kane Village, Varthur Hobli, belonging to the petitioners.
2. Sri. Vikram Huilgol, learned Senior Counsel appearing on behalf of Sri. Basavaraj S. Sappannavar, learned counsel for the petitioners, referring to the Survey Map produced at Annexure-D and the impugned endorsement produced at Annexure-F, contended that, the land belonging to the petitioner in the Survey Map at Annexure-D does not have access to road and there is no ingress and egress for the petitioner to reach to his land as the respondent-KIADB has put up compound wall surrounding the land belonging to the petitioner and therefore the impugned endorsement issued by

the respondent No.2 requires to be set aside in this Writ Petition.
3. Per contra, Smt. B.P. Radha, learned Additional Government Advocate appearing for respondent No.2, sought to justify the impugned endorsement and submitted that the petitioners have to approach the respondent - KIADB seeking land to have access to their land and accordingly, sought for dismissal of the Writ Petition.
4. Sri. Monesh Kumar K.B., learned counsel appearing for the respondent No.1 - KIADB argued for dismissal of the Writ Petition.

In the light of the submissions made by the learned counsel appearing for the parties and on careful consideration of the survey map produced at Annexure-D would indicate that the land claimed by the petitioners as well as the land belonging to the KIADB is surrounded on Rajakaluve. In that view of the matter, it is the duty of the respondent - authorities, particularly, respondent No.2, to provide the avenue for the petitioners to have access to the land. In that

view of the matter, I find force in the submission made by the learned Senior Counsel appearing for the petitioners that the impugned endorsement at Annexure-F is vague and without application of mind as access to the land belonging to the petitioners has been curtailed. In that view of the matter, I pass the following:
ORDER
(i) The Writ Petition is allowed.
(ii) The endorsement bearing No.LND(V)CR.121/2021- 22 dated 06.05.2022 issued by respondent No.2 is hereby set aside.
(iii) The matter is remitted to respondent No.2 to reconsider the issue afresh after providing opportunity of hearing to the petitioner/s as well as the respondent - KIADB.
(iv) Needless to say that it is open for the respondent No.2 to conduct survey in respect of the subject land with the assistance of the jurisdictional Director of Land Records, at the instance of the petitioner/s as well as the respondent - KIADB

and take decision in the matter so as to provide access to the land belonging to the petitioners is concerned.
(v) In order to avoid further delay in the matter, it is open for respondent No.2 to conduct survey on 24.08.2026 with the jurisdictional Director of Land Records, and the petitioner/s and the representative of KIADB shall be present at the time of conducting survey. Sd/- (E.S.INDIRESH) JUDGE
