22.07.2026 Sl. No.25(DL) Ct. No.14 srm IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE W.P.A. No. 4541 of 2026 Jahir Abbash Mondal Versus The State of West Bengal & Ors. Mr. Mohan Kumar Sanyal, Mr. Dwaipayan Sanyal …for the Petitioner. Mr. Brijendra Pratap Singh Mr. Nripendra Pratap Singh …for the State. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks for setting aside of order passed by Director of Madrasah Education dated 30th May, 2014 in connection with W.P. No.3594 (W) of 2014. 3. The petitioner contends that he was given appointment for the post of Peon on 7th December, 2003 by the Secretary, Gorora Haji Samsuddin Junior Girls’ High Madrasah. The petitioner joined on 17th December, 2003. However, the appointment of the petitioner as Peon was not approved by the Government. Thereafter, the petitioner preferred a writ petition being W.P. No.3594 (W) of 2014. The aforesaid writ petition was disposed of on 17th February, 2014 with the following direction: “The respondent No.3 is directed to take a decision in the above matter by passing a reasoned order in 2 accordance with law within a period of two months from the date of communication of this order and to communicate such decision to the petitioner within a week from the date of passing of such decision.” 4. Pursuant to such direction, order was passed by the Director of Madrasah Education, West Bengal on 30th May, 2014 rejecting the prayer of the petitioner. Challenging such order, the petitioner has preferred the present writ petition. 5. It is found that the impugned order under challenge was passed on 30th May, 2014. The present writ petition challenging the same has been filed after more than 11 years. There is no such explanation in the writ petition regarding such inordinate delay. In view of the above, the writ petition falls short of merit. 6. Accordingly, the writ petition being WPA 4541 of 2026 stands dismissed. 7. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 8. Interim order, if any, stands vacated. 9. All connected applications, if any, stand disposed of. 10. There shall be no order as to costs. 11. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 12. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
