This Writ Petition has been filed under Article 227 of the Constitution of India with the following prayers:- “(I) Issue an appropriate writ, order or direction commanding the learned Vth Additional District Judge, Dehradun to decide Misc. Case No. 134 of 2025 (Sri Mahant Ramadhar Das Mahatyagi & Ors. Vs. Mahesh Chandra Kukreti & Anr.) expeditiously within a time-bound period as this Hon'ble Court may deem fit and proper; (II) To issue such other suitable writ, order or direction which this Hon'ble Court may deem fit and proper; (III) To award cost of the writ petition to the petitioners.” 2. Heard Mr. Gaurav Pawar, learned counsel for the petitioners. 3. Mr. Gaurav Pawar, Advocate, appearing for 1 2026:UHC:2166 the petitioners submitted that the petitioner no.1, aged about 71 years, and the other petitioners has filed an Application under Section 151 of the Code of Civil Procedure, 1908 seeking modification of the decree dated 11.09.2019. The said Miscellaneous Civil Application (No.134 of 2025) (Original Suit No.4 of 2010) is pending before the Court of learned Vth Additional District Judge, Dehradun. 4. In the facts and circumstances of the case, the learned Vth Additional District Judge, Dehradun is directed to make an endeavor to decide the said Miscellaneous Case No.134 of 2025, “Mahant Ramadhar Das and Others Vs. Mahesh Chandra Kukreti and Another” expeditiously, as per law, without granting any unnecessary adjournment to either party. 5. The present Writ Petition (WPMS No.749 of 2026) is disposed of accordingly. 6.
