Order On Board 12.08.2026
1. Following reliefs have been prayed in this petition:-
“10.1 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ by quashing the impugned order dated 09.04.2026 (Annexure P-1) passed by respondent no. 2. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ by restraining the respondent no. 3 Bank not to take over the forceful possession of petitioners property till the decision of petitioners' Second Appeal no. 491/2026 pending before DRT Jabalpur filed on 06.05.2026 or till the decision on interim relief.
3 10.3 Any other relief as deemed fit by the Hon'ble Court.”
2. At the outset, learned counsel for the parties submit that the issue involved in the present writ petition stands squarely covered by the
order passed by this Court in WPC No. 2799 of 2026 {Ravi Dubey and Another vs. Authorized Officer (Pratul P. Bhelonde) Pragati Mahila Nagarik Sahakari Bank Limited and Others} and other bunch of petitions decided on 24.07.2026. It is jointly prayed that the present writ petition may also be disposed of in terms of the observations and findings recorded therein. The relevant paragraphs of the said judgment are reproduced below:–
“7. Since by the aforesaid notification the Additional Charge of D.R.T., Jabalpur has been assigned to D.R.T.-2 Ahmedabad accordingly these writ petitions are disposed of with liberty to the petitioners to approach D.R.T.-2, Ahmedabad by filing
appropriate
proceedings,
including applications for listing and interim relief. Since interim protection has already been granted by this Court in favour of the petitioners, the same shall continue till the stay applications are considered by D.R.T.-2, Ahmedabad. It is, however, made clear that the petitioners shall approach the Tribunal without delay and shall not seek any adjournment on the ground that they are protected by the interim orders passed by this Court.
4
8. The D.R.T.-2, Ahmedabad shall consider the petitioners' applications for interim relief/stay and pass appropriate orders thereon in accordance with law, as expeditiously as possible.
9. With the aforesaid observations and directions, all the writ petitions stand disposed of. It is made clear that all the parties shall be at liberty to avail such remedies and file such applications before the competent D.R.T. as may be available to them in accordance with law.”
3. Since the grievance of the petitioner is identical to the one considered in WPC No. 2799 of 2026 {Ravi Dubey and Another vs. Authorized Officer (Pratul P. Bhelonde) Pragati Mahila Nagarik Sahakari Bank Limited and Others} and other bunch of petitions decided on 24.07.2026, and the petitioner in the present case is also seeking the same relief, the writ petition is accordingly disposed of in terms of and in line with the aforesaid order. No order as to cost(s). sd/- (Amitendra Kishore Prasad) Judge Vishakha
