The petitioner is apprehending his arrest in connection with Complaint Case No. 412 of 2016, registered for the offence under Sections 33, 41 and 42 of the Indian Forest Act and Sections 2 and 3 of the Forest Conservation Act, pending in the court of learned Sub- Divisional Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner of clearing the forest land for storing the stone chips. He next submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-17 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of clearing the forest land for storing the stone chips.

Considering that the only allegations is there against the petitioner of clearing the forest land for storing the stone chips and further the petitioner is having no criminal antecedent and disclosure to

that effect has been made in para-17 of the petition, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
