Dr. Navin Barik, Ms. Esha Acharya, Mr. Rimik Chakraborty …for the Respondent No.6. 1. The petitioner alleges that the respondent nos.6 and 7 are running unauthorized tea stalls in front of her house. The petitioner filed a complaint before all the authorities, including the municipal authority. 2. In my view, the petitioner is required to file a comprehensive representation before the Commissioner, Siliguri Municipal Corporation with details of the allegations and why she has reason to believe that the tea stalls are unauthorized. 2 3. If such application is filed within a period of two weeks from date, the Commissioner, Siliguri Municipal Corporation shall act and proceed in accordance with law and pass a reasoned order. The same shall be communicated to the petitioner. If it is found that the tea stalls are unauthorized, steps shall be taken for demolition thereof. If it is found that the stalls are running with permission from the Municipal Corporation, and other authorities, the reasoned order shall reflect so. The reasoned order shall be communicated to the petitioner. 4. The entire exercise shall be completed within a period of eight weeks from the date of receipt of the petitioner’s application. 5. Accordingly, the writ petition is disposed of. 6. However, there shall be no order as to costs. 7. The parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
