Affidavit of service filed by the petitioner is taken on record. The petitioner has assailed the report submitted by the Revenue Inspector of Binpur-II Block submitted on 19th June, 2026 in connection with an earlier writ petition in WPA 13425 of 2026.
Learned counsel for the Pradhan, Harda Gram Panchayat under Binpur-II Block produces a copy of the
order passed by this Court on 23rd June, 2026 in the earlier writ petition wherein this Court has placed reliance on the said report submitted by the Revenue Inspector (though the date of the report has been wrongly recorded as 18th June, 2026) and has held that on physical verification it was found that the private
2 respondents raised construction under the government scheme maintaining side space from the mud wall house of the petitioner. The writ petition was dismissed by this Court. The order relied upon by this Court in the earlier writ petition has been assailed in the present application. Though the petitioner has referred to the report filed in the earlier writ petition, he has deliberately suppressed the fact that the writ petition was dismissed upon placing reliance on the said report. The report which was considered by this Court in the earlier writ petition has been assailed in the present writ petition, which is not permissible under the law. Since this Court dismissed the earlier writ petition upon consideration of the report submitted therein by the Revenue Inspector, the same cannot either be assailed in the present writ petition or dealt with by this Court herein. The writ petition is devoid of any merit and accordingly dismissed. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
