The petitioner has approached this Court by the present writ petition with a grievance that after an Order dated 29.07.2016 passed by the learned Member, Foreigners Tribunal no. 2, Boko, Kamrup in BFT no. 313/2016 declaring the petitioner as not a foreigner, the petitioner submitted a copy of the same to the jurisdictional Booth Level Officer [BLO] for removing of ‘D’ mark put against the petitioner in the Voters List. The petitioner also submitted representations before the respondent no. 4 and the respondent no. 6 on 25.11.2025 for removal of ‘D’ mark appearing against her name in the Draft Voters List of 2026. Having received no response from the said authorizers, the petitioner also preferred an appeal before the respondent no. 3 on 12.01.2026. As no communication has been received from any of the said authorities, the petitioner is before this Court by the present writ petition. 3. Mr. Payeng, learned Standing Counsel, Home and FT has placed a copy of a Speaking Order bearing no. KEL.67/2025/F.T. Case/1869 dated 12.02.2026 passed by the respondent no. 6 in deference to BFT Case no. 313/2016, decided by the learned Member, Foreigners Tribunal no. 2, Boko, Kamrup in relation to the petitioner. 4. From the Speaking Order passed by the respondent no. 6, it is evident that the respondent no. 6 has considered the Order dated 29.07.2016 passed by the learned Member, Foreigners Tribunal no. 2, Boko, Kamrup in BFT Case no. 313/2016 and heard the petitioner- in-person on 12.02.2026. Having considered the evidences submitted by the petitioner; a verification report submitted by the Deputy Superintendent of Police [Border] vide Office Letter bearing no. KP[B]/149/2025/280 dated 27.11.2025; and the Order dated 29.07.2016 of the learned Member, Foreigners Tribunal no. 2, Boko, Kamrup; the respondent no. 6 has passed the Speaking Order to remove ‘D’ mark against the name of the petitioner appearing in the Voters List of Part no. 187, Voter Serial no. 41, House no. 6, EPIC no. FRH0011765 of no. 27 Chamaria LAC with immediate effect. 5. In view of the Speaking Order so passed, the grievance of the petitioner is found to Page No.# 3/3 have effectively redressed and therefore, there is no necessity to proceed further with the writ petition. Mr. Sikdar, learned counsel for the petitioner has submitted that in view of the Speaking Order dated 12.02.2026, he is not pressing the writ petition. 6. The writ petition stands accordingly closed. 7. A copy of the Speaking Order bearing no. KEL.67/2025/F.T. Case/1869 dated 12.02.2026 placed by Mr. Payeng, learned Standing Counsel, Home and Foreigners Tribunal; and the Office Letter bearing no. KEL.67/2025/F.T.
