Learned advocate for the petitioner submits that the case was initiated on the basis of an application under Section 175(3) of the BNSS. There was a dispute and difference over the issue, which is relating to the monetary transactions in respect of the partnership of a gym. Learned advocate for the State opposes the prayer for anticipatory bail and refers to the amounts, which have been paid. Prima facie, I find the documents to the extent of Rs.5.25 lakhs. I have also taken into account the statements there were certain breach of promises, which are prima facie reflecting. Having considered the overall circumstances of the case, I am of the opinion that custodial interrogation of the

present petitioner may not be warranted in the facts of the case. Accordingly, the prayer for anticipatory bail is allowed. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also abide by the conditions laid down under Section 438(2) of the Cr. P.C/482(2) of the BNSS. The petitioner shall meet the I.O as and when required. Accordingly, the application for anticipatory bail being CRM(A) 2134 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
