JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Special Case No.30/2026 pending before the Court of IV Addl. District & Sessions Judge, Mandya arising out of Crime No.88/2011 registered by Besagarahalli Police Station, Mandya, for offences punishable under Sections 395 read with Section 34 of Indian Penal Code filed under Section 483 of BNS, 2023 is before this Court seeking for regular bail. 2. Heard learned counsel for the parties. - 3 - HC-KAR CNR: KAHC010351272026 NC: 2026:KHC:38315 CRL.P No. 7472 of 2026 3. FIR in Crime No.88/2011 was registered by Besagarahalli Police station, initially for offence punishable under Section 395 of IPC against unknown person based on the first information dated 20.12.2011 by Sanhahullah Khan S/o Mohideen Khan. After completing investigation, charge sheet was filed against five persons and petitioner herein was arraigned as accused No.2. Since the petitioner was absconding, a split up case was registered against him before the Committal Court and his presence was secured on 10.01.2026 and thereafter the case was committed to the jurisdictional Sessions Court and is pending in S.C.No.30/2026. His bail application filed before the trial court in Crl.Misc. No.319/2026, was rejected on 28.04.2026. Therefore, he is before this court. 4. FIR in the present case was registered against 5 unknown persons and during the course of investigation some of the accused were arrested and after completing investigation, charge sheet has been filed against 5 persons and petitioner herein is arraigned as accused No.2 in the charge sheet filed for offences punishable under - 4 - HC-KAR CNR: KAHC010351272026 NC: 2026:KHC:38315 CRL.P No. 7472 of 2026 Section 395 read with Section 34 of IPC. Since the petitioner was shown as absconding in the charge sheet, case against him was split up by the committal Court and as against other accused persons case was registered in SC No.88/2019. In the said case, after a full-fledged trial, accuse No.1, Appaji B.M has been acquitted by the trial Court by judgment and order of acquittal dated 20.10.2022. The petitioner is now arrested in the split-up case on 10.01.2026 and is in custody for the last more than 6 months. He has undertaken to co-operate with the trial Court for the purpose of speedy disposal of the case and also to abide by the conditions that may be imposed on him. 5. Considering the aforesaid aspects of the matter, following order is passed: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.30/2026 pending before the Court of IV Additional District and Sessions Judge, - 5 - HC-KAR CNR: KAHC010351272026 NC: 2026:KHC:38315 CRL.P No. 7472 of 2026 Mandya, arising out of Crime No.88/2011 registered by Besagarahalli Police Station, Mandya, for offences punishable under Sections 395 read with Section 34 of Indian Penal Code, subject to the following conditions: a) The petitioner-accused No.2 shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without the permission of the said Court until the case registered against him is disposed of. f) Petitioner is directed to appear before the station house officer of Besagarahalli Police - 6 - HC-KAR CNR: KAHC010351272026 NC: 2026:KHC:38315 CRL.P No. 7472 of 2026 Station on every first Sunday of the month between 10.30 a.m. and 01.00 p.m. and mark his attendance till the case registered against him is disposed.
