Learned counsel for the applicant submits that when MA No.166/2023 was called for hearing, he was engaged before another Court, and therefore, could not appear. Consequently, the appeal was dismissed for want of prosecution. He further submits that non appearance of the applicant on the said date was bonafide, hence, it is prayed that the restoration application may be allowed and MA No.166/2023 be restored to its original number. 4. On due consideration of the reasons mentioned in the application, which is well supported by an affidavit of the applicant, the application is allowed and impugned Order dated 13.07.2026 passed in MA No.166/2023 is recalled. 5. The Registry is directed to restore MA No.166/2023 (Satya Prakash Verma vs. RP Jain & Ors.) to its original number and list the case before the Bench having the roster. 6.
