From perusal of the documents appended with the petition it appears that the grievance raised in the present petition is substantially the same as was raised by the petitioner in an earlier writ petition, i.e. W.P.(S) No. 3089/2026, in which the petitioner had sought, inter alia, a direction in respect of the departmental appeal preferred by him against the order of suspension. The aforesaid writ petition, W.P.(S) No. 3089/2026, was finally disposed of by this Court vide order dated 09.04.2026. Taking note of the submissions made by learned counsel appearing for the petitioner and the State, this Court directed respondent No.2 to consider and take a decision on the pending departmental appeal preferred by the petitioner, in accordance with law, expeditiously, preferably within a further period of 45 days from the date of receipt of the order. With the aforesaid observation and direction, the earlier writ petition was finally
disposed of.
3. It is not in dispute that the subject matter of the present writ petition arises out of the very same suspension and departmental proceedings and that the relief sought herein is substantially the same as the relief which was the subject matter of consideration in the earlier writ petition.

Once the earlier writ petition, founded on the same cause of action and seeking substantially the same relief, has been finally disposed of by this Court, a second writ petition for the same cause and relief is not maintainable. If the petitioner is aggrieved by non-compliance of the direction issued by this Court in the order dated 09.04.2026, it would be open to him to avail the appropriate remedy in accordance with law; however, a fresh writ petition on the same cause of action and for
3 / 3 substantially the same relief cannot be entertained.
5. In view of the aforesaid, this Court finds that the present writ petition is not maintainable and deserves to be dismissed on this ground alone. Accordingly, the writ petition is dismissed as not maintainable. SD/- SD/- (Bibhu Datta Guru)
