The petitioner is apprehending his arrest in connection with Rikhiya P.S. Case No. 68 of 2024, registered for the offence under Sections 147, 148, 149, 323, 325, 307, 353, 332, 333, 427, 504, 506 pending in the Court of learned Judicial Magistrate, 1st Class, Deoghar. 3. Learned counsel appearing for the petitioner submits that the allegations are made of pelting stone upon the vehicle of the Police against the petitioner and others. He submits that the police party entered into the house of Bhola Yadav in the mid night and for that altercation took place. He further submits that three of the co-accused persons have been granted anticipatory bail in A.B.A. No.4332 of 2024 by the co-ordinate Bench. He also submits that the petitioner is not having criminal antecedent as disclosed in para 12 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegation of pelting stones on the police are there. 5. Considering that co-accused persons have been granted anticipatory bail in identical situation and that the petitioner is not having criminal antecedent as disclosed in para 12 of the petition and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
