Case of the prosecution, in brief, is that the present Applicant was operating a Common Service Centre (CSC) and that co- accused Vinod Kumar Sandilya, by using the Applicant's CSC, fraudulently induced several women of Village Kundikala to undergo e-KYC for the Mahtari Vandan Yojana. It is alleged that under the guise of completing the KYC process, the Aadhaar cards of the women were misused and without their knowledge or consent, biometric authentication was obtained to fraudulently withdraw urea fertilizer in their names. The prosecution further alleges that the main accused, Vinod Sandilya, used the CSC ID of the present Applicant to obtain the thumb impressions of the women by deception and thereby facilitated the unauthorized withdrawal of fertilizer. During investigation, statements of witnesses, including Budhiyaro, Shyam and Sevari Sandilya, were recorded, wherein they alleged that urea fertilizer had been withdrawn in their names by misusing their Aadhaar cards under the pretext of KYC. On the basis of documentary evidence and the statements of independent witnesses 3 collected during investigation, the offences as mentioned above were registered against the present Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is submitted that the Applicant has been operating a Common Service Centre (CSC)/Lok Seva Kendra at Gram Panchayat Bhawan, Kundikala since 01.09.2017 and that all services rendered by him are carried out through the official online CSC portal, where the data is digitally maintained and cannot be manually altered. It is further submitted that the Applicant has no business, licence or involvement whatsoever in the procurement, distribution or sale of urea or any other agricultural fertilizer. It is contended that the main accused is the Applicant's brother, Vinod Kumar Sandilya, who independently operates an agricultural outlet adjacent to the Applicant's CSC and the Applicant has been implicated merely because of the proximity of his CSC to the said shop. It is also submitted that the prosecution case rests entirely on documentary and electronic evidence, including POS machine records and CSC portal data, which are already in the possession of the investigating agency and therefore, custodial interrogation of the Applicant is not required. It is 4 lastly submitted that the trial is likely to take considerable time for its conclusion, therefore, the Applicant may be granted anticipatory bail. 4. On the other hand, learned State Counsel opposes the application. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature and gravity of the allegations, the specific allegation that the present Applicant permitted the use of his Common Service Centre (CSC) ID for obtaining the biometric authentication of the beneficiaries under the guise of KYC and thereby facilitated the unauthorized withdrawal of urea fertilizer, the statements of the beneficiaries and other independent witnesses supporting the prosecution case, the documentary and electronic evidence collected during investigation and the fact that the investigation is still in progress, without further commenting anything on the merits of the case, this Court is of the considered opinion that no case is made out for extending the discretionary relief of anticipatory bail to the present Applicant. 5 7. 5 7. Accordingly, the Anticipatory Bail application of the Applicant – Deepak Kumar Sandilya, filed under Section 482 of the BNSS, 2023 in connection with Crime No.177/2026, registered at Police Station – Naya Rajpur (Rajpur), District Balrampur - Ramanujganj (C.G.) for alleged commission of offence punishable under Sections 318(4), 336(3) and 3(5) of BNS, is hereby rejected. 8.
