1. The applicants have preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as they have been arrested in connection with Crime No.128/2026, registered at Police Station – Jaijaipur, District - Sakti (C.G.) for the offence punishable under Sections 303(2), 324(3), 112 and 3(5) of Bharatiya Nyaya Sanhita, 2023.
2. As per the prosecution story, the complainant, Bhagirathi Chandra, a resident of Tushar Road, Police Station Jaijaipur, is posted as a Lecturer at Government High School, Beladula. On 10.05.2026, at about 09:00 PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.08.20 15:04:04 +0530
2 p.m., he parked his Swift car bearing registration No. CG-11-BK-1003, registered in his name, on the roadside in front of his house and went to sleep with his family members. At about 07:30 a.m. the next morning, he found that the window glass of his Swift car had been broken and a piece of stone was lying near the broken glass. Upon opening and inspecting the trunk of the car, he found that the spare tyre kept therein was missing. It was alleged that an unknown person had broken the car's glass by throwing a stone and had stolen the spare tyre, valued at approximately Rs.9,000/-. It was further alleged that the rear windshield of a Maruti Celerio bearing registration No. CG-11-DE-5118, parked on the roadside in front of the house of Ujjainlal Tandon at Jaijaipur, and the glass of a Maruti Ertiga bearing registration No. CG-05-AL, belonging to Prahlad Sahu, were also damaged. Further, the rear windshield of vehicle No. 4228, parked on the roadside near Lakhan Yadav's hotel at Jaijaipur, and the front windshield of a Mahindra Pickup bearing registration No. CG-11- BT-7008, parked on the roadside in front of Pankaj Sahu's shop, were also damaged by throwing bricks and stones. On the basis of the complainant's report, a crime was registered against an unknown person. After completion of investigation, the charge-sheet was filed before the competent Court.

Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the present case. He further submits that the applicant has been in judicial custody since 09.07.2026. It is submitted that the applicant has ten previous criminal antecedents of similar nature, the details whereof have been explained in Part-D of the bail application. It is further submitted that the charge-sheet has already been filed and, therefore, the conclusion of the trial is likely to take considerable time. Hence, it is prayed that the applicant be enlarged on
3 regular bail.
4. On the other hand, learned State counsel has opposed the bail application and submitted that the charge-sheet has already been filed. He further submits that the applicant has 10 previous criminal antecedents of similar nature which indicates that the applicant is a habitual offender. Accordingly, it is prayed that the present bail application be dismissed.
5. I have heard learned counsel for the parties and perused the documents available on record.

Considering the submissions advanced by learned counsel for the parties, the case diary and the material available on record and the fact that the the charge-sheet has been filed and the applicant has ten previous criminal antecedents of similar nature, which indicates that the applicant is a habitual offender, and also in light of the judgment rendered by the Supreme Court in Deepak Yadav v. State of Uttar Pradesh & Another, reported in (2022) 8 SCC 559, wherein the Hon’ble Supreme Court cancelled the bail granted to the accused on the ground of previous criminal antecedents, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.

Accordingly, the bail application of the applicant Nos. 1 and 2 - Harsh Sidar @ Bittu and Gulshan Bareth, respectively involved in Crime No.128/2026, registered at Police Station – Jaijaipur, District - Sakti (C.G.) for the offence punishable under Sections 303(2), 324(3), 112 and 3(5) of Bharatiya Nyaya Sanhita, 2023, is rejected.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
