Mr. Brajesh Jha Mr. Arnab Sau …for the State. Report filed by the State prepared by the CF&DEEL be kept with the record. Prima facie I find that there are materials, which establish the prosecution case but having regard to the fact that the petitioner was arrested in 2021 and is in custody for about five years and only two witnesses have been examined, out of the 22 witnesses cited in the charge sheet. Without entering into the merits of the case, I am inclined to grant bail to the petitioner. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of 2 Rs.10,000/- each, one of whom must be local to the satisfaction of learned ACJM, Kakdwip, South 24 parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District South 24 Parganas without the prior permission of the learned Court. The SDPO/DSP of the jurisdictional police station would monitor the further progress of the case and ensure that the witnesses are available on the dates fixed by the learned trial court. Any leniency be dealt with by the learned Special Court, in view of the directions passed above. Accordingly, CRM (M) 1213 of 2026 is allowed. Memo of evidence filed by the State is taken on record. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
