Heard the parties.
The petitioner has moved this Court for grant of bail in connection with S.T. No. 77 of 2026 arising out of Ormanjhi P.S. Case No.208 of 2024 registered for the offences punishable under sections 111(2), 111(3), 111(4), 111(5), 111(6) of the B.N.S., 2023 and under Section 25(1-A)/25(1-B)a/26(1)/26(2)/35 of the Arms Act and under Section 25(6) and 25(7) of the Arms (Amendment) Act.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was in illegal possession of a country made pistol with two live cartridges. It is further submitted that the allegation against the petitioner are false and the petitioner was not apprehended by the police at the time of the occurrence but the petitioner has been implicated in this case on the basis of statement of Saddam Hussain and Salim Ansari who have already been admitted to bail vide order dated 26.03.2025 in B.A. No. 2443 of 2025 and vide order dated 09.05.2025 in B.A. No. 3807 of 2025. It is further submitted that the petitioner has been in custody since 17.07.2025 as has been mentioned in para -10 of the bail application. It is then submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. It
is lastly submitted that the co-accused person with similar allegation has already been admitted to bail by this Court vide
order dated 10.03.2026 in B.A. No.1137 of 2026. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.J.C.-XVII, Ranchi, in connection with S.T. No. 77 of 2026 arising out of Ormanjhi P.S. Case No.208 of 2024 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
